CN Rail (T.CNR), logging companies and fishermen get the boot from BC First Nation lands

VANCOUVER - Buoyed by a landmark Supreme Court of Canada decision, hereditary chiefs of the Gitxsan (GIT-san) First Nations have served eviction notice to CN Rail, logging companies and sport fishermen to leave their lands.

Chief negotiator Gwaans (gwons) Bev Clifton Percival says these companies have until Aug. 4 to cease operations and leave 33,000 square kilometres of Gitxsan territory along the Skeena River in northwestern British Columbia.

Clifton Percival says the band has been trying to negotiate a treaty with the Crown since 2001 but hasn't made any progress and hasn't had any negotiations for several years.

She says in 2012, some of the lands awarded to the Gitxsan in an earlier high court ruling were given to the neighbouring Kitsumkalum (kits-um-kalem) and Kitselas (lit-sey-liss) nations in an agreement in principle signed with the provincial and federal governments.

The Gitxsan say because of the Crown's failure to consult them, the companies are trespassing.

Clifton Percival says timber sales, fishing licenses and rail shipments can continue after the Crown has obtained the consent of their chiefs.

A worthy sentiment fakmix, except for the portion about regressing in stages backwards. your assertion about ignoring the court and asserting the power of authority of government can cut both ways. post supreme court decision in BC, an ontario court recently won a 7-0 decison against a native band in that province, appealing all the way to the supreme court of canada. but even beyond that, if the courts be ignored, you are back to nation to nation agreements and treaties. That is the final for the thieves taking all they could for such a long time. All miners have to pay royalties and now they will have to pay to Indiens Canada is a beautiful country but country resources are run/mined by thieves. NO Tax Canada for all citizens if Royalty would be collected. Imagine this

The court decision on this matter was a stupid one and decided by our left wing liberal judges. I think it's time we played cowboys and indians again and settle this matter once and for all. Moreover the government of Canada run this country, not the Supreme Court of Canada who in essence works for the Government of Canada, not the other way around. Therefore whatever Parliament says should take precedent over this moronic court decision as Parliament are the Supreme legislators of Canad...
