Two key components of the Action Plan are the creation of a NWT Surface Rights Board Act and amendments to the Mackenzie Valley Resource Management Act (MVRMA).

Process

The proposed NWT Surface Rights Board Act will create a board which will have the ability to render binding decisions for disputes between land owners and holders of surface and subsurface interests in a situation where a negotiated access agreement cannot be reached. The Act will apply to the entire Northwest Territories. AANDC will develop the proposed legislation in consultation with Aboriginal organizations and governments, the Government of the Northwest Territories and other interested parties.

The majority of amendments to the MVRMA are focused on updating the legislation for clarity and certainty, considering the addition of modernizing elements, as well as implementing the results of the Joint Examination Process. AANDC will amend the legislation in consultation with Aboriginal organizations and governments, the Government of the NWT, boards and other interested parties. Amendments to the MVRMA may include restructuring the land and water boards. A Chief Federal Negotiator, Mr. John Pollard, will lead the consultations with Northwest Territories Aboriginal organizations, the Government of the Northwest Territories and will also engage the land and water boards and other interested stakeholders.
